Can You Stop a Foreclosure Sale in Colorado?
If a foreclosure sale is scheduled on your home, you may still be able to stop it — but the deadlines are firm. Here are the main ways Colorado homeowners avoid the sale.
1. Cure the default
Colorado lets homeowners stop a foreclosure by paying what is needed to bring the loan current. File a Notice of Intent to Cure with the Public Trustee at least 15 calendar days before the sale, request the cure figures, and pay by noon the day before the sale. If you don’t have the cash, a short-term bailout or second-lien loan from a private lender can sometimes fund the cure when there is enough equity.
2. Work it out with your servicer
A repayment plan, forbearance or loan modification can stop or postpone the sale. Apply as early as you can — applications close to the sale date may not pause it. A free HUD-approved counselor can help: Colorado Foreclosure Hotline, 1-877-601-4673.
3. Sell before the sale
If keeping the home isn’t realistic, selling — to a buyer on the open market or for cash — pays off the loan and puts the remaining equity in your pocket. If you owe more than the home is worth, a short sale may be possible with the lender’s approval.
4. Legal options
Filing bankruptcy creates an automatic stay that generally halts a foreclosure sale, but it has serious long-term effects. If you think the foreclosure has errors, or bankruptcy may make sense, talk with a Colorado attorney before the sale date. Watch out for foreclosure scams
Never pay upfront fees to “save” your home, never sign your deed over in a hurry, and don’t stop talking to your lender because someone told you to. Under the Colorado Foreclosure Protection Act, contracts with homeowners in default must be in writing and include a right to cancel.
Common questions
What is the last day to stop a foreclosure sale in Colorado?
To stop it by curing, file a Notice of Intent to Cure at least 15 calendar days before the sale and pay the cure amount by noon the day before. Other options, like a sale of the home or a loan workout, also need to be finished before the sale.
Can a private loan stop my foreclosure?
Sometimes. If your home has enough equity, a short-term bailout or second-lien loan from a private lender can pay the amount needed to cure the default.
Can I sell my house if a foreclosure sale is scheduled?
Yes. You can sell up until the sale as long as the sale closes in time to pay off the loan. Selling usually protects far more of your equity than an auction.
